Terms of Service

1. General Information

Diavolana ("we", "us", or "our") operates a subscription-based e-commerce platform shipping curated products from Madagascar to Germany. By using our services, you agree to these terms.

2. Subscription

Subscriptions are billed monthly in advance via PayPal. You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing cycle. We do not offer refunds for partial billing periods.

3. Products

Each month, your subscription includes one curated product from Madagascar, announced before it ships. The product changes every month. We reserve the right to substitute a product of equal or greater value if the featured item becomes unavailable.

4. Shipping & Delivery

Products are shipped from Madagascar to your delivery address in Germany. Shipping times may vary depending on customs processing. We are not responsible for delays caused by customs authorities or force majeure events.

5. Right of Withdrawal

Under German law, consumers have a 14-day right of withdrawal for distance contracts. However, this right does not apply to subscription services that have already begun with your explicit consent before the withdrawal period expires, nor to perishable goods once the seal has been broken.

6. Liability

We are liable for damages caused by intentional or gross negligence. For simple negligence, our liability is limited to foreseeable, contract-typical damages. This limitation does not apply to personal injury or mandatory statutory liability.

7. Governing Law

These terms are governed by German law. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
